Shoreland zoning rules, encapsulated within the Wisconsin State Statutes and Wisconsin Administrative Code, have changed six times since 2010.  In the past, counties were allowed to adopt shoreland zoning standards that were more restrictive than those contained in Wisconsin Administrative Code NR 115.  As of the signing of 2015 Wisconsin Act 55 by the Governor, counties cannot regulate a matter in their shoreland zoning ordinance more restrictively than the matter is regulated by a shoreland zoning standard contained in Wis. Admin. Code NR 115. However, counties can continue to regulate a matter that is not regulated by a shoreland zoning standard.

The changes within 2015 Wisconsin Act 55, required that the counties adopt revisions to their existing shoreland ordinance to bring it into compliance with the state statues and wisconsin administrative code. Department of Planning & Zoning staff utilized the Wisconsin DNR Model Shoreland Zoning Ordinance as a base for recreating Chippewa County’s Shoreland Ordinance.   

Text which has been added into the model ordinance can be seen in RED with an underline such as this:  INSERTED.  Provisions from the existing county shoreland ordinance (Chapter 54) have been inserted into the model ordinance.  Please note that some of the model ordinance text has been deleted from one section of the model ordinance, but added into a different section of the proposed ordinance.  Text which has been deleted can be seen in red with a strikethrough such as this:  DELETED.  Once again, please note that some of the language may have been deleted from one section of the model ordinance and added into a different section of the proposed ordinance.
