NOVEMBER 2003 MEETING
REGULAR COUNTY BOARD MEETING

                            November 12, 2003
                           
9:35 a.m.

Meeting called to order by Chairman Michael J. Murphy. Roll Call. All Supervisors Present except Supervisors Goodman, Price and Schunk.

The County Clerk announced that nomination papers for County Board are available. They cannot be circulated until December 1st. A certificate of appreciation was to be awarded to Duayne Schunk for his years of service, but he was absent from the meeting.

Tony Semington, asked the County Board to allow for issuing concealed carry permits within this county. He noted that this is not a costly issue and would not want to see the revenue go to another county.

Steve Wall, life long resident of Chippewa County and Veteran said that he would be happy to be an instructor for the concealed carry classes. He thought people should have the right to protect themselves.

Larry Olson, said he called Coline Adams from Minnesota to ask how the concealed carry is going over there. He noted that it is a revenue source for Minnesota and that there are jobs that are created from issuing permits.

Robert Seibel, a member of the Bloomer Rod and Gun Club, noted that it is premature to opt out at this time. He read a statement that was signed by members of the Bloomer Rod and Gun and members of the Chippewa Falls Rod and Gun Club, asking the County Board to table any action concerning the concealed carry bill.

Al Grossmier wanted to know why the agenda was set to vote on something that hasn’t even been passed yet. He noted that there is no liability for the Sheriff’s Department since the exemption has been written in the law.

John Shumach, said the bill authorized the County to opt out. He wanted to know why the County has an opt out option in the first place. County Clerk, Kathy Bernier stated that at the state legislature the representatives have been very careful in requiring counties to do additional responsibilities due to the numerous unfunded mandates that have been imposed on county government.

Robert Seibel took the floor again to comment on the loss of his Constitutional rights. His concern was with zoning regulations. He wanted to put a trout pond in to control flooding on his property. He said he is not allowed to do it, because it is a wetland. He said it is not a wetland it is a floodplain. The water comes from Duncan Creek and he wants it to go back to Duncan Creek. His black ash trees are dying due to the wet soil and he would like to save the trees. He is having problems with the Corps of Engineers. He noted that, "we have lost all our rights", and he wants the County Board to assist him in this fight, or he and others will shut down hundreds of acres of hunting land.

Dave Rynders presented the Human Services Springsted Report to the County Board. The report suggests several different changes that can be made in the Human Services Department that can create efficiencies and cut costs. Schafer asked, if the Board accepts this study at this time, does that means all of the recommendations will be implemented? Sippel noted that at this time we do not know just what and how we are going to implement the recommendations. The Human Services Board will evaluate and make changes as they determine feasible. The report was accepted and placed on file.

RESOLUTION NO. 57-03

RESOLUTION CREATING A PETTY CASH FUND IN THE
VETERAN’S SERVICE OFFICE

NOW THEREFORE BE IT RESOLVED, that Veterans Office Petty Cash fund #100-00-11813-000 is created in the amount of $150.00 to facilitate the reimbursement of Veterans Office van drivers and payment of small emergency relief payments to certain veterans on a timely basis.

RESOLUTION NO. 58-03

AUTHORIZE THE SALE OF TAX DEED ACQUIRED LAND TO
TOWN OF LAFAYETTE

NOW, THEREFORE BE IT RESOLVED, that the parcel of land in the Town of Lafayette, described as CSM #1750, Document #591640, (including Outlot 1 of CSM #1375), of the S ½ of the SE ¼ of Section 12, T28N-R8W, Parcel #22808-1244-71750 OAD, be sold to the Town of Lafayette for $676.19, which includes the back taxes and accrued interest against the property, plus legal expenses incurred by the County in taking title to the property, and

BE IT FURTHER RESOLVED, that the County Clerk be authorized to issue a deed to the Town of Lafayette upon receipt of payment.

RESOLUTION NO. 59-03

RESOLUTION AUTHORIZING REPURCHASE OF TAX DEEDED LANDS

NOW, THEREFORE BE IT RESOLVED, that the Chippewa County Board of Supervisors does hereby grant the Petition to Repurchase and upon payment of the delinquent taxes and interest, the applicable cost of the In Rem proceeding and the deed preparation costs, the County Clerk is authorized and directed to execute, on behalf of Chippewa County, a quit claim deed to the property described as Lot 9 and the southeast 40 ft. of Lot 12, Block 17 of the Original Plat of the City of Chippewa Falls, Section 6, T28N-R8W, Parcel #22808-0643-60011712, to Bradley K. Rihn, as his interest appeared prior to the In Rem proceeding, unless the ownership interest has been legally changed.

BE IT FURTHER RESOLVED, that this Resolution shall remain in force and effect until December 23, 2003, and in the event payment in full has not been made by December 23, 2003, this resolution shall be null and void and the right to repurchase the aforementioned property shall be forfeited.

RESOLUTION NO. 60-03

RESOLUTION NO. 61-03

CHIPPEWA COUNTY BOARD OF SUPERVISORS RESOLUTION
ESTABLISHING ADDITIONAL ZONING DEPARTMENT FEES

NOW, THEREFORE, BE IT RESOLVED, that an "Alternative System Plan Review" fee of "$175.00" be added to the Chippewa County Zoning Department Fee Schedule. Said changes shall be charged by the Zoning Department, commencing January 1st, 2004 and continue until changed by subsequent resolution.

RESOLUTION NO. 62-03

RESOLUTION TO ADOPT A MORATORIUM ON THE ISSUANCE OF
PERMITS FOR MULTIPLE FAMILY DWELLINGS IN THE AGRICULTURAL
DISTRICT FOR A PERIOD OF 120 DAYS

NOW, THEREFORE BE IT RESOLVED that the Chippewa County Board of Supervisors does hereby impose a moratorium on all future or pending applications for zoning permits for multiple family units in the Agricultural District in the zoned townships of Chippewa County. During the term of this moratorium unless earlier terminated by the County Board of Supervisors, Chippewa County will not accept any applications for such permits or act upon any pending applications for which the applicant proposes to erect a multiple family unit in the Agricultural District in the Towns of Anson, Eagle Point, Hallie, Lafayette, Ruby, Wheaton and Woodmohr in Chippewa County, Wisconsin; and

BE IT FURTHER RESOLVED that the moratorium imposed by this resolution shall be in effect for a period of 120 days from the date this resolution is adopted; and

BE IT FURTHER RESOLVED that during this moratorium, the Zoning Committee, Zoning Department and aforementioned County Zoned Townships shall study, analyze and develop recommendations to resolve the issue of multiple family dwellings in the Agricultural District and report those recommendations to the County Board of Supervisors no later than February 11, 2003.

RESOLUTION NO. 63-03

RESOLUTION TO APPROVE THE CHIPPEWA VALLEY REGIONAL AIRPORT
OWNERSHIP AND OPERATION AGREEMENT

NOW, THEREFORE BE IT RESOLVED, that the Chippewa County Board of Supervisors does hereby approve the attached CHIPPEWA VALLEY REGIONAL AIRPORT OWNERSHIP AND OPERATION AGREEMENT commencing on January 1, 2004; and

BE IT FURTHER RESOLVED, that the County Board Chair and the County Clerk are hereby authorized to execute the Agreement on behalf of Chippewa County.

Motion (Schafer/Marquardt) to adopt. Carried by Roll Call. All Supervisors present voting Aye except Supervisor Rineck. Adopted by a 25 to 1 vote on 11-12-03.

Resolution No. 64-03 Authorizing the Chippewa County Sheriff Not to Issue Concealed Weapons Licenses Pursuant to Senate Bill 214 was withdrawn from the agenda prior to the meeting.

RESOLUTION NO. 65-03

RESOLUTION TO TRANSFER FUNDS FROM THE GENERAL FUND
TO HIGHWAY FUND FOR COUNTY M BRIDGE PROJECT

NOW THEREFORE BE IT RESOLVED, that the Chippewa County Board of Supervisors authorizes the transfer of $44,824 from the Chippewa County General Fund Account #100-09-59100-300 to Highway Fund Account #701-28-49107-000 to complete funding for this project.

Ordinance No. 5-03 Amending Section 2.03 Regarding County Board Meeting Times was given its second reading. Motion (King/Marquardt) to adopt. Carried by Roll Call. All Supervisors voting Aye except Supervisors Boettcher, Dahl, Hutton, Kellen, McCarthy, Rineck, and Sedlacek. First reading 10-14-03. Adopted 11-12-03 by a 19 to 7 vote.

Ordinance No. 6-03 Repealing Section 5.25 and Creating Section 58-37 Courthouse Complex Parking Regulations was read. Motion (McCarthy/Schafer) to suspend second reading. Carried. Motion (Ludwigson/Boettcher) to adopt. Carried by Roll Call. All Supervisors present voting Aye. Adopted 11-12-03.

Jane Cooper was appointed to the Long Term Support – Family Support/Birth to Three Committee, for a term expiring April 30, 2004.

James Dahl was appointed to replace Reginald Conley on the Human Services Board, for a term expiring April, 2004.

Zoning Communication was read from Douglas Clary, stating that the requirements of Section 59.69 have been complied with for Zoning Petitions 9 and 10.

Amendatory Zoning Ordinance No. 6-03, asking the Board to rezone a parcel of land in the Town of Anson from the Agricultural District to Residential A District, was given its first reading. Second reading 12-9-03.

Amendatory Zoning Ordinance No. 7-03, asking the Board to rezone a parcel of land in the Town of Anson from the Agricultural District to the Residential A District, was given its first reading. Second reading 12-9-03.
